VillageMetrics - Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VillageMetrics application and related services ("the App"), provided by Wellbeing Applications LLC, a New Jersey limited liability company ("we," "our," or "us"). By using the App, you agree to be bound by these Terms.
1. Purpose of the App
VillageMetrics is designed to help families and caregivers track behavioral observations, medication schedules, journal entries, and therapeutic data to support children with neurodevelopmental or behavioral conditions. The App is intended to support—not replace—professional medical, psychological, or therapeutic care. Always consult your child's healthcare provider before making treatment decisions.
2. User Roles & Responsibilities
VillageMetrics supports multiple types of participants, including parents, guardians, therapists, teachers, and other caregivers.
- Only parents/guardians can create child profiles, and must confirm their parental/guardian status during creation.
- Parents/guardians serve as primary data controllers for each child profile.
- The same person may have different roles for different children (e.g., parent to their own child, caregiver to another family's child).
- Contributors may be invited by parents to log behavior scores, journal entries, and other data.
- Account creators must be at least 18 years old. Parents may authorize family members under 18 to contribute data under parental supervision.
Parents determine who may access or view data, set permissions, and can revoke caregiver access at any time. Permission levels include:
- Contribute-only access (can add journal entries but cannot read)
- Read journal entries
- View behavior data and analyses
- Access medical information (medications, treatment correlations)
Professional caregivers (therapists, teachers, etc.) remain responsible for maintaining their own licensing requirements, professional standards, and ethical obligations when using VillageMetrics. The App does not replace professional judgment or supervision.
3. HIPAA Compliance & Data Security
VillageMetrics is built on HIPAA-compliant infrastructure. We:
- Encrypt data in transit and at rest
- Limit access to authorized users only
- Do not collect advertising IDs or analytics data
- Use HIPAA-compliant partners for voice transcription and infrastructure services
- May temporarily cache encrypted data for performance optimization

4. Data Ownership & Permissions
Parents/legal guardians retain ownership and control of all data associated with their child's profile.
Contributors provide data voluntarily and grant permission for that data to be used within the App and viewed by those with appropriate access.
Parents can:
- Control caregiver permissions
- Export analysis reports as PDF documents
- Export raw journal entry data in CSV format
- Delete their child's data at any time
All generated insights, analyses, and reports belong to the family and may be used for any purpose. The underlying technology and systems that produce these insights remain the intellectual property of Wellbeing Applications LLC.
5. Notification Preferences & Optional Features
Push Notification Options:
Parents can choose between generic notifications (default) or enriched notifications that may include the child's name and other PHI. For families with multiple parents, both parents must opt-in to enriched notifications. Caregivers receive notifications based on the parents' preferences.
Quality Assurance Consent (Optional):
During account setup, you may optionally consent to allow VillageMetrics staff to review your journal entries and "Ask Anything" conversations for quality assurance purposes to verify the app is functioning as intended. This consent is off by default and only a small percentage of users participate.
6. AI Features & Disclaimers
VillageMetrics includes AI features that:
- Process and transcribe voice recordings into journal entries
- Tag entries with hashtags and generate summaries
- Infer behavior scores from journal content (not clinical assessments)
- Generate BCBA-style behavioral analysis (AI-generated, not from licensed BCBAs)
- Generate periodic analysis reports based on tracked data
- Provide automated empathy responses to journal entries
- Offer responses via the "Ask Anything" tool, which uses AI to analyze your data and answer questions about your child's information
These features are for informational purposes only and should not be relied on as medical or clinical advice. AI-generated behavior scores, BCBA-style analyses, insights, and "Ask Anything" responses are computer-generated inferences, not professional evaluations from licensed practitioners. Always consult your healthcare provider for medical decisions.
IMPORTANT: The App tracks correlations between medications, therapies, activities, caregivers, and behavior scores to provide you with data to share with your healthcare providers. THESE CORRELATIONS ARE NOT RECOMMENDATIONS TO START, STOP, INCREASE, DECREASE, OR CHANGE ANY MEDICATIONS OR THERAPIES. Even when the App shows correlations between behavior scores and specific medications (prescription or over-the-counter), therapies (such as ABA therapy), or activities, you should not make care decisions based solely on this data. All medication and therapy decisions should be made in consultation with qualified healthcare professionals who can consider your child's complete medical history and individual circumstances.
Journal entries and AI-generated empathy responses are processed automatically without human review or monitoring. We do not monitor content for safety concerns and do not report concerning content to authorities or third parties. If you have immediate safety concerns, contact appropriate emergency services or healthcare providers directly.
Once data is exported (e.g., as a PDF), it is no longer under our control. Parents and caregivers are responsible for managing any PHI shared outside the platform.
7. Community Insights (Optional)
Parents may opt in to share anonymized data to contribute to aggregated insights for the broader VillageMetrics community.
- No names, journal entries, or direct identifiers are included
- Opt-in is optional and can be changed at any time
8. Account & Subscription
VillageMetrics operates on a subscription model with per-family pricing.
- Each subscription covers one family with unlimited children and unlimited caregivers
- Subscriptions are owned and paid for by parents/guardians only
- Caregivers receive free access when invited by parents - no separate payment required
- Professional caregivers (therapists, teachers, etc.) should be invited by each family they work with
- A free trial period is available for new families
- Subscription terms and pricing are presented in-app
- Subscriptions renew automatically unless canceled via your app store settings
- No refunds are offered unless required by law
9. Termination
You may delete your account at any time.
If a parent or guardian deletes their account and they are the sole owner of a child's profile, all associated data will be permanently deleted.
We may suspend or terminate your access if you violate these Terms.
10. Prohibited Uses
You agree not to:
- Use the App in a way that violates any law or regulation
- Upload offensive, threatening, or harmful content
- Misrepresent your identity or your role in a child's care
- Attempt to reverse-engineer, copy, or exploit the App's code or services
- Use one account to manage multiple unrelated families as a parent (each family requires their own subscription paid by that family's parents)
- Access our services through automated means or third-party integrations not expressly authorized by us
- Share login credentials with unauthorized individuals
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, AVAILABLE AT ALL TIMES, OR THAT THE INSIGHTS IT PROVIDES WILL BE ACCURATE OR LEAD TO SPECIFIC OUTCOMES. We strive to maintain high service availability but cannot guarantee 100% uptime due to maintenance, updates, or unforeseen circumstances.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. WE ARE NOT LIABLE FOR ANY DECISIONS YOU MAKE BASED ON THE INFORMATION PROVIDED IN THE APP.
12. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WELLBEING APPLICATIONS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, DATA LOSS, HEALTH DECISIONS, OR THERAPY/MEDICATION OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
13. Dispute Resolution
Any dispute between you and Wellbeing Applications LLC will be resolved through binding arbitration under the rules of the American Arbitration Association.
- Arbitration will take place in New Jersey
- Each party will bear its own costs
- The laws of New Jersey govern these Terms, regardless of your location
14. Changes to These Terms
We may update these Terms as our services evolve. If we make material changes, we'll notify you through the App or by email. Your continued use of VillageMetrics means you accept any updates.
